Terms & Conditions for BookNorthernCyprus.com

  1. Terms and conditions of booking over the internet – PLEASE READ THESE TERMS AND CONDITIONS OF USE BEFORE BOOKING. By using this website you agree and accept the terms and conditions of use. If you do not agree do not use this website. BOOKNORTHERNCYPRUS.com reserves the right to change, modify, add or remove parts of these terms at any time. We ask you to please check for changes. If you continue to use BOOKNORTHERNCYPRUS.com after changes to these terms have been made means you have accepted the changes.
  2. Legal Identity – BOOKNORTHERNCYPRUS.COM is the trading name of KIBRIS TRAVEL SERVICES LTD (The Company), registered in North Cyprus number M.Ş 894 at 3, Ankara Sokak, Lefkoşa, (VAT registration number ************). These booking conditions form the basis of your contract with the Company. This contract shall be governed in all respects by North Cyprus law and shall be subject to the exclusive jurisdiction of the North Cyprus Courts.
  3. Booking Confirmation - No contract shall exist between the Company and you until you receive a confirmation invoice, by e-mail, issued by the Company and we receive full payment for the total value of the booking. The party leader must be at least 18 years of age and 25 years of age for car hire drivers.
  4. North Cyprus Prices – All rates are in the currency specified. We reserve the right to change prices due to currency fluctuations, the increase of VAT or any other taxes and to correct any errors in our prices. Prices are shown on our website and can go up or down.
  5. Payment Terms - You will be required to pay 100% of your chosen services price before we can confirm your booking. Sometimes, you may be able to complete your booking by paying a deposit only. If this option is available, it will be clearly stated at the point of sale and you will be required to pay to us for each person in your party when you book unless this is within 30 days of the date of arrival at the accommodation when the full amount for the booking is payable. The deposit amount will be specified by us when your booking is made. If it is not specified then it will be 100% of the chosen services price. If a deposit is allowed, the deposit payment will be your only commitment until 30 days before your date of arrival. Within two weeks of booking, we will send you a Confirmation Invoice by email showing how much you owe us. You must pay the amount on the invoice at least 30 days before your planned arrival date at the accommodation. If you do not, we reserve the right to treat your booking as cancelled and to charge you a cancellation fee up to 100% of the total on that last invoice.
    If payment for your booking is made by credit card a handling fee will apply. Please check fee at the time of booking.
    Should you instruct your credit/debit card company to “charge back” any payment(s) properly due from you in respect of your booking, we will charge you an administrative fee of £10/15.00 EURO per incident and associated costs. We further reserve the right to cancel your booking and/or take legal action against you for all outstanding payment(s).
  6. If you change or cancel your booking.
    If you want to change any details of your booking (such as changing to different accommodation or changing a name in your party), we will do our best to help. If a change you requested is made we will charge an ‘amendment fee’ for each detail of the booking which we allow you to change without a cancellation. If you make the allowed change more than 30 days before the date of arrival at the accommodation, the fee will be £20/30 EURO per change per person. If you make the allowed change within 30 days of the date of arrival at the accommodation, the amendment fee will be £30/45 EURO per change per person.
    If you want to cancel your booking, within 30 days of your arrival date and you have paid for your chosen services in full, such request will incur a 100% cancellation charge. Any lesser charges are at the discretion of BOOKNORTHERNCYPRUS.COM and after discussion with the affected partner or partners. This is not applicaple between 01/07 – 30/9 and during all holidays including Christian and Moslem holidays. Some types of accommodation (such as apartments, or hotel rooms with reductions for three adults) are priced according to the number of people staying there. If your booking changes because someone in your party cancels, we will recalculate your booking cost based on the new number of people staying. If fewer people share the accommodation, then the cost for them may go up. This extra cost is not a cancellation charge.
  7. Alterations By Us – In the event of a confirmed booking being unavailable BOOKNORTHERNCYPUS.COM will offer an alternative solution. If this is not acceptable we will offer a full refund. If we have to cancel your arrangements, we will refund to you the price you have paid for your chosen services in full.
  8. Quality of Northern Cyprus accommodation and services – The client/customer acknowledges that star ratings are given locally and are not the same as internationally recognised. These should only be used as a guideline. The same applies for amenities offered such as single rooms, baby cots, extra beds, child seats and any other amenities described. We have taken all care to make sure that the services you have booked with us are provided by a reputable supplier. This supplier should follow the laws and regulations of North Cyprus. However, overseas safety standards are generally lower than in the UK, few hotels meet EC fire safety recommendations even in Europe. The facilities and features listed of each accommodation are under the direct control of the suppliers and BOOKNORTHERNCYPRUS.com cannot be held responsible if those facilities or features are not available to the client during the holiday period. If a certain facility or feature is important then the client should check with BOOKNORTHERNCYPRUS.com to make sure it will be available during the clients date of stay.
  9. Travel arrangements – You are responsible for selecting each part of your travel arrangements. You accept that we have not in any way selected, assembled or arranged any part of your travel arrangements. We are acting as booking agents only and do not contract as principal. By booking these travel arrangements, you accept that you will be entering into a contract with each of the carriers, accommodation providers and other suppliers of services on their standard terms and conditions. You understand that where you have chosen more than one travel product component, you will be entering into multiple contracts. We have made no representations about the suitability of the transport, accommodation, products and services offered for sale through us and the inclusion or offering for sale of any accommodation, products or services by us does not constitute an express or implied endorsement or recommendation by us of such accommodation products or services. We undertake no responsibility for and are not liable for the misrepresentations, breaches of contract, breaches of statutory duty or negligence of any of the carriers, accommodation providers and other suppliers of services who sell their products and services through us.
    This means that in the event of you suffering personal injury, illness or death as a result of any act or omission of a carrier, accommodation provider or other supplier of services (or their employees) or you having any complaint about the quality of the services provided or having any other complaint at all, your sole right of redress will be against the independent third party who provided such service and that we will be under no liability at all (whether in contract, tort or otherwise howsoever).
  10. Information accuracy – Reasonable care has been taken by BOOKNORTHERNCYPRUS.com to ensure that the content of the website including all hotel and other information is correct and accurate. The client/customer accepts that BOOKNORTHERNCYPRUS.com cannot be held responsible for any inaccuracies in such information nor liability for changes to facilities that have not been notified to BOOKNORTHERNCYPRUS.com by the relevant hotel and other suppliers in question. Whilst every effort is made to keep the information up-dated BOOKNORTHERNCYPRUS.com cannot be held responsible for errors, omissions or misleading information contained in the hotel or other services information.
  11. Restriction of Liability – BOOKNORTHERNCYPRUS.com cannot be held responsible for delays, losses, changes of schedules, damages etc that may occur in any of it’s suppliers services. BOOKNORTHERNCYPRUS.com will not be liable for any damages or personal injury caused by, included but not limited to, any failure of performance, error, omission, interruption, defect, delay in operation of transmission, computer virus or line failure. BOOKNORTHERNCYPRUS.com will not be liable for any damages or injury, including but not limited to, special or consequential damages that result from the use of, or the inability to use, the materials in this website, even if there is negligence, or if BOOKNORTHERNCYPRUS.com or an authorized BOOKNORTHERNCYPRUS.com representative has been advised of the possibility of such damages, or both.
  12. Behaviour - When you book with us, you accept responsibility for any damage or loss caused by you or any member of your party. Full payment for any such damage or loss must be paid direct at the time to the accommodation owner or manager or other supplier. If you fail to do so, you will be responsible for meeting any claims subsequently made against us (together with our own and the other party’s full legal costs) as a result of your actions. We expect all clients to have consideration for other people. If in our reasonable opinion or in the reasonable opinion of any other person in authority, you or any member of your party behaves in such a way as to cause or be likely to cause danger, upset or distress to any third party or damage to property, we are entitled, without prior notice, to terminate the stay of the person(s) concerned. In this situation, the person(s) concerned will be required to leave the accommodation concerned. We will have no further responsibility toward such person(s). No refunds will be made and we will not pay any expenses or costs incurred as a result of the termination.
  13. Force Majeure - We regret that the Company cannot accept responsibility or pay any compensation where the performance or prompt performances of our contractual obligations is prevented or affected by reason of circumstances amounting to "force majeure". Circumstances amounting to "force majeure" include any event which the Company or the supplier of the service in question could not, even with all the due care, foresee or avoid such as war or threat of war, riot, civil strife, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions, governmental action and all similar events beyond the Company's control.
  14. Our responsibility to you - We promise to use reasonable skill and care in selecting the suppliers who will supply the services you book with us. Providing we have done so we will have no responsibility for the provision of the actual services or for the acts or omissions of the supplier(s) concerned or any of its employees, agents, suppliers or subcontractors. Please note it is your responsibility to show that all reasonable skill and care has not been used if you wish to make a claim against us.
    We will not be responsible for any injury, illness, death, loss (for example loss of enjoyment), damage, expense, cost or other sum or claim of any description whatsoever which results from any of the following:- the act(s) and/or omission(s) of the person(s) affected or any member(s) of their party or the act(s) and/or omission(s) of a third party not connected with the provision of your holiday and which were unforeseeable or unavoidable or 'force majeure' as defined in clause 13 above.
    We cannot accept responsibility for any services which do not form part of our contract. In addition, regardless of any wording used by us on our website, or elsewhere, we only promise to use reasonable skill and care. The promises we make to you about the services we have agreed to arrange as part of our contract - and the laws and regulations of North Cyprus will be used as the basis for deciding whether the services in question had been properly arranged or provided. If the particular services which gave rise to the claim or complaint complied with local laws and regulations applicable to those services at the time, the services will be treated as having been properly provided. This will be the case even if the services did not comply with the laws and regulations of the UK which would have applied had those services been provided in the UK.
    We cannot accept any liability for any damage, loss, expense or other sum(s) of any description which on the basis of the information given to us by you concerning your booking prior to our accepting it, we could not have foreseen you would suffer or incur if we breached our contract with you or which did not result from any breach of contract or other fault by ourselves or our employees. Additionally we cannot accept liability for any business losses. You must tell the supplier concerned about your complaint.
    Complaints - If you have a problem during your holiday, please inform the service provider immediately who will endeavour to put things right. You may also contact us directly on our customer service telephone number. It is strongly recommended that you communicate any complaint to the supplier of the services in question without delay.
    Insurance in North Cyprus - We consider adequate travel insurance (which covers at the least the cost of cancellation, and the cost of assistance, including repatriation in the event of accident or illness) to be essential. Please read your policy details carefully and take them with you on holiday. It is your responsibility to ensure that the insurance cover you purchase is suitable and adequate for your particular needs. We do not check insurance policies.
  15. Passports, Visas and Health Requirements - Unless you tell us otherwise, we are entitled to assume that all members of your party hold full E.U passports valid for the entire duration of the arrangements you chose to purchase. It is your responsibility to ensure that all members of the party have all appropriate documentation.
  16. Special Requests – Where possible we will pass special requests on to the supplier when you book. Your special requests must be made in writing/e-mail to us. We will tell you if there is a charge for the request. The relevant supplier will only guarantee requests charged for or confirmed in writing.
  17. Flight Reconfirmation – It is your responsibility to ensure that you reconfirm the departure date and times of all your flights at least 72 hours prior to departure. This is particularly important in respect of your return flight home from North Cyprus.
  18. Links to third party websites – Hyperlinks from BOOKNORTHERNCYPRUS.com are provided for your reference only. It does not imply any endorsement by BOOKNORTHERNCYPRUS.com of the material on such websites.
  19. Disabled clients – There are very limited facilities available to disabled clients both at the accommodations and in general. If any member of the party has any form of disability full details must be provided to BOOKNORTHCYPRUS.com so as we may be given the opportunity to advise you prior to booking. We reserve the right to cancel or decline the booking.
